Terms of Service

§ 01Application

These Terms define the conditions of the Service and the rights and obligations between users and us. They apply to all use of the Service. Users must use the Service after agreeing to these Terms and our Privacy Policy.

§ 02Description of the Service

The Service is a free beta service for developers and AI agents. It retrieves weight and body-fat measurements from smart-scale provider APIs, including Withings and Tanita Health Planet, and exposes normalized data through a REST API and JSON-first CLI.

The Service is currently provided free of charge. If we introduce paid features or subscriptions, we will separately present pricing, conditions, and cancellation terms, and those terms will apply only after user agreement.

§ 03Beta Availability

The Service is provided as a free beta. We may change, suspend, or terminate features, specifications, service scope, supported providers, API responses, CLI behavior, or the availability period. During beta, we do not guarantee stable operation, continuous availability, backward compatibility, or support response times.

§ 04Eligibility, Accounts, and API Keys

• Users under 18 must obtain consent from their legal representative before using the Service.
• Users sign in by the methods we specify, such as Google account sign-in, magic links, or device authorization, and use the Service by issuing API keys.
• Users are responsible for managing API keys, sessions, CLI configuration files, and credentials. Users must not allow third parties to use them or lend, transfer, or share them.
• We are not responsible for damage caused by insufficient API key management, user error, third-party use, or unauthorized access, except where attributable to us.
• If a user becomes aware of possible leakage or unauthorized use of an API key, the user must promptly revoke or rotate it, or contact us.

§ 05Provider Connections

Users may connect accounts for which they have legitimate access rights, including Withings and Tanita Health Planet, through the Service. Users must comply with each provider's terms of service, API terms, and privacy policy.

Provider-side API changes, authentication changes, outages, usage limits, service termination, account restrictions, or similar circumstances may make some or all of the Service unavailable. We are not responsible for unavailability, data retrieval failures, or delays caused by provider-side circumstances.

§ 06Medical and Health Disclaimer

The Service is intended to retrieve, store, normalize, and provide user measurement data in a machine-readable format. It does not provide medical diagnosis, treatment, prevention, advice, weight-loss coaching, health evaluation, or emergency response.

Measurement data may be inaccurate, delayed, or incomplete due to devices, providers, data retrieval timing, network conditions, user settings, or other factors. Users should consult a licensed professional for health, medical, exercise, diet, or weight-loss decisions.

§ 07Prohibited Conduct

Users must not engage in any of the following when using the Service.

• Violating laws, public order, morals, or these Terms
• Infringing the rights or interests of us, other users, providers, or third parties
• Accessing or attempting to access accounts, API keys, or measurement data without proper authority
• Sharing, selling, or transferring API keys, OAuth tokens, or session information to third parties
• Overloading the Service, sending automated high-volume requests, or bypassing rate limits
• Interfering with, analyzing, bypassing, or abusing the Service, API, authentication flow, or security mechanisms
• Using the Service as the sole basis for important decisions such as medical, emergency, insurance, employment, or credit decisions
• Reselling or re-providing the hosted API to third parties without our written permission
• Any other conduct that we reasonably determine to be inappropriate

§ 08Data Deletion and Disconnection

Users can disconnect a provider and delete stored tokens by running daylo disconnect <provider>. Users can also request deletion of measurement data, all stored provider tokens, and internal retrieval state by calling DELETE /api/v1/me/data. This endpoint deletes measurement and connection data; it does not delete the account, sessions, API keys, limited inquiry, security, or backup records, or minimal legal acceptance records retained for a period reasonably necessary to verify contract formation and handle disputes.

The Privacy Policy describes data retention, backups, and current and future uses of measurement data.

§ 09User Data Rights and Limited License

Rights in measurement data and other user data that users store in or retrieve through the Service remain with the user or the relevant rights holder. These Terms do not transfer ownership of that data to us.

Users grant us a non-exclusive, royalty-free, and limited license to store, copy, transmit, transform, and otherwise technically process user data only as necessary to provide, maintain, and secure the Service and respond to inquiries. We will not use this license for other purposes, except that we may have service providers process data to the extent necessary for those purposes.

This license lasts only for as long as necessary for those purposes, including retention in accordance with the Privacy Policy.

§ 10Intellectual Property and Licenses

Rights in software, documents, designs, names, logos, and other content related to the Service belong to us or their rightful owners.

The CLI and code included in the public repository may be used under the MIT License stated in that repository. That license does not grant any rights to our hosted service, provider credentials, production environment, trademarks, non-public server implementation, or third-party services.

§ 11Self-Hosting and Compatible Deployments

Users may operate Daylo-compatible deployments using public code or compatible implementations at their own responsibility. In that case, the operator of that deployment is responsible for its operation, security, provider contracts, data protection, user support, and legal compliance. Such deployments are separate from the hosted service we provide.

§ 12Changes, Suspension, Restriction, and Termination

We may change, suspend, or terminate all or part of the Service without prior notice to users. For material changes, we will make reasonable efforts to notify users by posting on the Service, email, GitHub, or another appropriate method.

We may restrict the use of an account, API key, or provider connection to the extent necessary if the user violates these Terms, threatens the security of other users or the Service, if required by law, or if Service operations are materially disrupted. Except in urgent cases, we will provide notice of the reason and an opportunity to cure where reasonably possible.

We may terminate access to the Service if there is a material violation, a violation is not cured within a reasonable period after notice, violations are repeated, or there is fraud, unlawful conduct, or a serious security risk. We will notify the user of the reason where reasonably possible.

§ 13Disclaimer of Warranties

The Service is provided as is. We do not warrant safety, accuracy, completeness, continuity, fitness for a particular purpose, continuing compatibility with provider APIs, complete retrieval, storage, or restoration of data, or that the Service will be error-free or outage-free.

This section applies only to the extent permitted by law.

§ 14Limitation of Liability

The exclusions and liability cap in this section do not apply to liability arising from our willful misconduct or gross negligence, or to liability that cannot be excluded or limited under the Consumer Contract Act or other applicable law. In all other cases where we are liable, liability is limited to actual, ordinary, and direct damages, and our total liability is capped at JPY 10,000.

Except in the cases excluded from the limitation above, we are not liable for lost profits, lost business opportunities, data loss, substitute service costs, indirect damages, special damages, or consequential damages.

§ 15User Indemnity

If we incur loss or expense because of a user's intentional or negligent violation of these Terms, infringement of third-party rights, or improper use of the user's account, API key, or provider connection, the user must indemnify us only for reasonable, ordinary, and direct loss and expense resulting from that conduct. This does not apply where the cause is not attributable to the user.

§ 16Changes to These Terms

We may change these Terms where reasonable in light of legal changes, Service changes, operational needs, or other circumstances. We will post the content of the changes and the effective date on the Service. For material changes, we will provide reasonable advance notice before the effective date by email, GitHub, or another appropriate method.

§ 17Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance over disputes related to the Service.
